These Terms and Conditions govern access to and purchase of products on the website https://brintos.com/ (hereinafter, the “Website”) owned by CLIP STYLE EUROPE (hereinafter, “BRINTOS”), which is the entity that markets the products displayed on it and is responsible for the contractual relationship maintained with the user (hereinafter, the “User”) for the purchase of products on the Website.

Notwithstanding the foregoing, depending on the product purchased by the User, it may be subject to specific conditions based on the product's characteristics. These specific conditions are set out in these terms and conditions.

2. Object

This document sets out the terms and conditions (hereinafter, the “Terms and Conditions”) that will govern browsing through the Website and the purchase of products offered by BRINTOS to Users.

Any matter not expressly provided for in these Terms and Conditions shall be reserved to BRINTOS, without prejudice to the application of the provisions of current regulations.

By checking the box to accept these Terms and Conditions, and by following all the steps online, the User expressly accepts them, and their acceptance has the same validity as a handwritten signature. The User acknowledges being of legal age and capacity to enter into the obligations arising from their actions on the Website, and that they have read and understand its Content.

In any case, in order to contract with BRINTOS, the User must be of legal age (≥ 18 years) and have the necessary legal capacity to enter into contracts.

3. Access to the website

Access to the Website is completely free, requiring Users only the data necessary to manage their purchases. Access to the Website by minors is prohibited. However, if a minor accesses the Website, it will be presumed that such access has been carried out with the prior and express authorization of their parents, guardians, or legal representatives, without prejudice to BRINTOS' right to carry out any verifications it deems appropriate.

Access to and browsing of the Website do not require registration, although to make any purchase or to receive advertising, information and periodic offers of promotional campaigns and our products, it will be necessary to complete the web forms enabled for this purpose.

The data provided by Users must be truthful. If such information is incomplete, inaccurate, or false, Users agree to indemnify BRINTOS against any damages, losses, or third-party claims that may arise as a result of the inaccuracy or falsity of the data provided. Under no circumstances will BRINTOS be responsible for the accuracy of the data provided by Users; therefore, each User will be solely responsible for any consequences, errors, or omissions that may arise from the lack of quality of the data.

4. Electronic contracting

In accordance with the provisions of the applicable regulations, contracts concluded electronically will produce all the effects provided for by law when consent and the other requirements necessary for their validity are met.

In any case, the electronic medium on which the contract entered into electronically is recorded will be admissible as documentary evidence in case of dispute between the parties.

For these purposes, it will be understood that following all phases of the purchase process and, where applicable, paying the corresponding amount, necessarily implies providing the consent required for the contract.

4.1. Prior Information

These Terms and Conditions are available to all Website Users from the following link https://brintos.com/ free of charge.

Access to the hiring process is completely free, with no additional associated costs other than those of the User having an Internet connection.

All products sold are fully described in their corresponding product sheets made available to Users, and any issues not expressly indicated therein are not included.

The contract between BRINTOS and the User is considered perfected from the moment the User completes the contracting procedure by pressing the "Buy" button or similar, it being understood that following all the phases of the electronic contracting procedure and including all the requested data, together with marking the corresponding box relating to the acceptance of these Terms and Conditions, constitutes a direct manifestation of the User's will to accept them.

BRINTOS, as an information society service provider, will archive the electronic document formalizing this contract. This electronic document will be accessible to the User, who may download and print it, and will include these Terms and Conditions. BRINTOS will send the User an email confirming the purchase, along with the corresponding purchase receipt.

BRINTOS will introduce appropriate and sufficient technical means to identify and correct technical errors in information management as it becomes its responsibility.

The language in which the contracting procedure will be processed and in which this contract is formalized will be, unless otherwise indicated, Spanish.

4.2. Purchase procedure

The purchase process for the products offered is carried out electronically through the Website. Anyone with internet access can make a purchase, and all products offered through the Website are publicly accessible without any restrictions on their viewing.

The complete procedure that all Users who wish to purchase any of the products offered through the Website must follow will consist of the effective completion of the following steps:

  1. Once the User has accessed the Website, they must select the products they are interested in. It is very important that they review the descriptions, features, conditions, delivery times, and final prices indicated in each product's information sheet, and specify the desired quantity of each item. The selected products will then be added to their shopping cart on the Website.
  2. Next, once all the products you wish to purchase have been selected, the User must begin the electronic purchase process, for which they only need to click on the final purchase button.
  3. To proceed with the purchase, we need to have all the User's information. The User must also complete the information related to billing and shipping.
  4. Regarding the "Payment Method" tab, the User only needs to enter their preferred payment method from those offered by BRINTOS on the Website (card, PayPal, etc.). BRINTOS will never have access to your bank details; these are managed directly by the corresponding banking institutions.
  5. After payment is made, the User will receive an order confirmation email, which will include a summary of the items purchased, the shipping method requested, and the destination address.

If an incident occurs at the time of payment that prevents the payment from being made, the User will receive an automatic payment error message and their order will not be processed until the payment process is successfully completed.

4.3. Product characteristics

The website offers various types of products. BRINTOS sells glasses , the characteristics of which are described in the information provided for each product. This information includes the lens type, category, and UV protection. A description of the frame and the product's dimensions are also provided.

The information included on the website in each product and service description, in its photographs, graphic or iconographic representations or videos, as well as trade names, trademarks or distinctive signs of any kind, is for informational purposes only. Therefore, BRINTOS disclaims any liability for errors in this information, although it undertakes to take all measures within its power to correct any such errors or omissions as soon as possible after being notified of them.

5. Economic conditions

5.1. Prices

The current price of the products will be as indicated on the Website at any given time, next to their description, and will be publicly accessible there for viewing. All prices are shown in Euros, unless expressly stated otherwise.

All prices shown are final prices, expressly including Value Added Tax (VAT) and any other applicable charges. However, the final price will include any applicable increases or discounts. In any case, all these amounts will be shown to the User in a detailed breakdown during the checkout process.

The products sold on the Website will be subject to the corresponding VAT in each case (Generally 21% for glasses).

5.2. Discount codes

BRINTOS may periodically offer discount codes to its Users. These discounts may only be applied according to the instructions specified by BRINTOS for each code, and in any case, Users may only use one code per order. The use of discount codes is not compatible with certain promotional offers and collections.

5.3. Payments

Once the User has purchased any of the products on the Website and paid through any of the available methods, BRINTOS will send the User an email with the order information.

In any case, payments made online will be processed through a platform provided by an external financial institution using secure SSL protocol. For identification purposes, please confirm that the web address begins with https://brintos.com/ .

The contract will only be effective once BRINTOS receives payment confirmation. Upon receipt of full payment, BRINTOS will automatically send the corresponding simplified invoice to the User's email address.

5.4. Payment methods

For single purchases, we accept standard credit and debit cards (Visa, MasterCard, American Express) as well as other methods such as PayPal or Apple Pay, depending on availability at the time of purchase.

6. Delivery conditions for purchased products

6.1. Home delivery

We only ship to mainland Spain and the Balearic Islands. We do not ship to Ceuta, Melilla, or the Canary Islands.

Home delivery of purchased products will be made to the physical address indicated by the User. Home delivery will not incur an additional cost unless otherwise stated.

Delivery times: Orders are processed from our central logistics warehouse. Therefore, the estimated delivery time is usually 12 to 15 calendar days after order preparation. In the case of the Canary Islands , due to logistical reasons, the estimated time is 20 to 23 days .

However, during periods of high demand or for logistical reasons beyond our control, this period could be extended to a maximum of 30 calendar days.

BRINTOS cannot control shipments once they have been handed over to the relevant postal service, and therefore will not be responsible for any delay in delivery when the order has been delivered to them on time.

7. Guarantees and returns

All products offered are original and without any defects, and come with their legally recognized warranty periods.

The consumer and user may return to BRINTOS, free of charge, any product that is defective or does not conform to the description provided, within a period of three (3) years from the date of receipt of the product. If the defect becomes apparent more than two (2) years after delivery of the product following purchase, the User must demonstrate that the fault already existed at the time of delivery.

The consumer must notify BRINTOS via email Click here , indicating the defective product and attaching evidence.

Once BRINTOS has analyzed the issue, they will inform you whether a refund is applicable. If so, BRINTOS will instruct you on how to send the defective product to their warehouse. The address will be as follows:

If the product does not conform to the contract, the User may choose between demanding repair or replacement of the product, unless one of these options is objectively impossible or disproportionate. If repair cannot be carried out and the replacement is not satisfactory, the consumer may choose to terminate the contract.

BRINTOS will return the amounts paid within a maximum period of fourteen (14) calendar days from the termination of the contract.

8. Right of withdrawal

The consumer and user will have the right to withdraw from the order made remotely without alleging a reason, during a period of fourteen (14) calendar days from the correct receipt of the product.

The consumer and user will not be responsible for the direct cost of the return to BRINTOS, unless otherwise specified, provided that it is done according to the detailed process.

The product must be in perfect condition and with all its original labels and packaging. Failure to comply may result in a depreciation of the product's value.

Once BRINTOS verifies that the order is in optimal condition, it will proceed to return all amounts paid by the consumer and user (including basic initial delivery costs) within a maximum period of fourteen (14) calendar days from the notification of withdrawal.

9. Product exchange policy

BRINTOS does not allow direct exchanges between purchased products. If the User wishes to exchange a product, they must exercise their right of withdrawal (return) and subsequently purchase the desired new product.

10. Customer service

BRINTOS provides Users with a customer service department to resolve any questions or complaints:

11. Website usage rules

Accessing or using the Website for illegal or unauthorized purposes is prohibited, and the User will be solely responsible for any consequences thereof. Specifically, the following are prohibited:

  • Using the Website to cause damage, interruptions or defects in its operation.
  • Transmit viruses or malicious code.
  • Collecting personal data from other users.
  • Registering with a false identity or impersonating third parties.
  • Accessing restricted areas or servers without authorization.
  • Infringing intellectual property rights.

Failure to comply with these obligations may lead to the blocking of the offending User's account.

12. Intellectual and industrial property rights

BRINTOS owns or holds the corresponding licenses for the intellectual and industrial property rights of the Website, as well as all the content offered therein (texts, photographs, logos, trademarks, designs). It is prohibited to modify, copy, reproduce, publicly communicate, transform, or distribute all or part of the content without prior authorization.

BRINTOS assumes no responsibility for links to third-party websites that may appear on the Website, as it has no control over their content or operation.

13.2. Links to BRINTOS' social media channel

BRINTOS provides links to its social media accounts. Access to these external platforms is the user's responsibility and is governed by the terms and conditions of those platforms.

14. Responsibilities and guarantees

BRINTOS is committed to ensuring that the content and data of its products are reliable and accurate. However, it does not guarantee the complete absence of errors or the continuous availability of the Website due to force majeure or external technical failures.

BRINTOS will not be responsible in case of product unavailability or inability to deliver due to force majeure, theft or loss, although it will try to find the best solution for the user.

15. Modifications to the terms and conditions

BRINTOS reserves the right to modify these Terms and Conditions. Substantial modifications will be communicated. The User will be deemed to have accepted the modifications upon making a new purchase.

16. Suspension and modification of the website and prices

We reserve the right to modify or discontinue the Service without prior notice. Our product prices are subject to change without notice.

17. Notifications

All communications relating to the contract will be made in writing (email) in accordance with the established procedures.

18. Language and Principles

The Spanish version of these terms will prevail in case of conflict. BRINTOS is committed to defending the rights of the people involved in the manufacture of its products and expects the same from its suppliers.

19. Confidentiality and data protection

In accordance with Organic Law 3/2018 on the Protection of Personal Data, all data provided will be processed according to our Privacy Policy, which the User must accept in order to use the system.

20. Generals

The partial invalidity of any clause will not affect the validity of the remaining clauses. BRINTOS's failure to exercise a right does not constitute a waiver of that right.

21. Partial nullity

All clauses must be interpreted independently. If a clause is declared null and void, it will be replaced by another that preserves the intended effects, while the validity of the rest of the contract will remain in effect.

22. Applicable legislation and competent jurisdiction

For any legal dispute arising from this Website, current Spanish law will apply. We will submit to the Courts of Pontevedra, as well as, where applicable, to the Consumer Arbitration Tribunals. Notwithstanding the foregoing, in the event of a dispute with a consumer, we will submit to the Courts of the consumer's domicile.
